Family of State-napped Swedish Child Savors Small Victory

Family of 'state-napped' child beats social services



A judge has handed defeat to a social services agency that dispatched police officers to an India-bound jetliner more than two years ago to take into custody a 7-year-old boy because he was being homeschooled.

Word of the victory – that the government is not allowed to terminate the rights of the boy's parents – comes from Ruby Harrold-Claesson, president of the Nordic Human Rights Council.

Harrold-Claesson, who also has been reinstated as the representative for the parents months after she was removed on the objections of the Gotland, Sweden, social services agency, said it's a hopeful sign in the long-running custody dispute over Domenic Johansson, now 10.

Gotland Court Refuses to Hear Transfer of Custody In the Case of Domenic Johansson



We've received news today that Gotland Courts have refused to grant a hearing on the transfer of custody of now 10 year old Domenic Johansson from his parents and to foster parents. During a December 9th preliminary hearing, the Johanssons and representatives of Gotland Social Services were asked to present evidence supporting or refuting the need for custody transfer. After reviewing all the evidence, news was recieved today that the presiding judge has determined there was not enough evidence suggesting Annie and Christer Johansson should permanently lose the custody of their son. To the best of our knowledge, this is the very first time in the 2.5 years of this battle, where the Johanssons were finally allowed representation in court by an attorney of their choosing, Ruby Harrold-Claesson.

Swedish authorities threaten to completely revoke parental rights of homeschooling couple



STOCKHOLM, October 12, 2011 (LifeSiteNews.com) - Swedish authorities that seized a seven-year-old boy from his family because the parents chose to homeschool him are threatening the parents with permanent loss of their child and a complete termination of their parental rights.

Swedish police snatched Domenic Johansson, son of Christer and Annie Johansson, in June 2009 from an airplane bound for India, Annie’s homeland. The main reason for the seizure was that Domenic was homeschooled. Since then Domenic’s entire family has been denied virtually any contact with their son.

Domenic, now 9 years old, has been held in state foster care for more than 24 months.

In June 2010, the Home School Legal Defense Association (HSLDA) and the Alliance Defense Fund (ADF) filed a joint application on behalf of the Johansson family at the European Court of Human Rights (ECHR) and have been working to support the family since shortly after Domenic’s seizure.

“The United States Supreme Court has called the termination of parental rights the family court equivalent of the death penalty,” stated Michael Donnelly, Director of International Relations at the Home School Legal Defense Association.

“The government shouldn’t abduct and imprison children simply because it doesn’t like homeschooling. That’s bad enough. But now the state is going even further by attempting to get the parents out of the way altogether,” said ADF Legal Counsel Roger Kiska. “This simply cannot stand. We will do everything in our power to help reunite this family.”

Both ADF and HSLDA are currently asking for letters to be written to Swedish officials and embassies in an attempt to renew attention to the family’s case and to encourage Swedish officials to release Domenic back to his family.

We demand the unconditional and immediate return of Domenic Johansson to his parents.



Why this is Important

“[A child] shall, wherever possible, grow up in the care and under the responsibility of his parents…” Declaration of the Rights of the Child (1959)

Christer Johansson, a Swedish citizen, and Annie Johansson, an Indian citizen, were recently informed by the Social Services in Gotland Kommun of their intention to transfer full custody of their son Domenic to a foster family. This is allegedly in the best interest of Domenic. However, Social Services have failed to demonstrate a single report of negligence or physical or emotional abuse by this family. Indeed, Social Services have engaged in an inhumane campaign of alienation: not allowing visitation or any communication between Domenic and his parents since November 2010.

Domenic Johansson has suffered physical and emotional deterioration due to the unfounded and cruelly prolonged isolation from his parents, extended family, and friends. He has not been allowed to even keep contact with other relatives and friends, in violation of the general rules outlined in Swedish law 22 § tredje stycket SoL. While in the care of Social Services, Domenic has been taken on several occasions to the hospital with stress-induced vomiting, the result of forced isolation from his biological family, which had constituted his sense of security and basic emotional identity. Domenic has both a Swedish father and an Indian mother with strong extended family ties. However, Gotland Social Services has ignored this Swedish regulation: A “[b]oard should be particularly vigilant with regard to immigrant children since many of them come from cultures where family membership has a different meaning than we are accustomed. A broken contact with family and community may at worst lead to isolation and disorientation in adulthood (Bill 1989/90: 28 p. 73).”

We demand a full investigation into the handling of this case by the Gotlands Kommun Social Services and the court appointed lawyers of Domenic Johansson (Eva Ernstson), Christer Johansson (Lars Dahlstrom) and Annie Johansson (Shantu Brahmbhatt). In direct defiance of Swedish and European Union laws, Gotland City Courts have violated the Johansson family's guaranteed rights to be represented by the lawyer of their choice. They have instead appointed lawyers with little previous experience, who uncritically accepted social services statements regarding the physical and psychological state of child and parents even though they were never corroborated by experts and who, therefore, undermined their clients’ rights to a fair trial. The system has failed this family and many others and must be changed.

We demand the immediate reunification of the family and that steps be taken to restore the emotional and psychological bond so abruptly broken by the unwarranted actions of the Social Services at Gotland Kommun.

n a monumental development for homeschool rights, Swedish parents may permanently lose custody of their child. The implications of the controversial case are enough to send chills down the spine of anyone who chooses to homeschool their children.

Swedish officials on the Island of Gotland are moving to terminate the parental rights of homeschool parents Christer and Annie Johansson. The state seized 7-year-old Domenic in June 2009. Currently 9 years old, the boy has been held in state foster care for more than 24 months. Domenic’s entire family has been denied virtually any contact with him during that time.

Now, the state wants to give permanent custody to the foster family.

Jag är mycket orolig över hur familjen Christer, Annie och Domenic Johansson har blivit behandlade av svenska myndigheter. Jag har tagit del av domstolsprotokoll, vittnesförhör och familjens egen berättelse och jag kan inte förstå hur det har kunnat gå så långt som till ett LVU-omhändertagande av Domenic. Som svensk medborgare trodde jag att omhändertaganden och familjehemsplacering av ett barn i vårt land gjordes när ett barn far illa på grund av att föräldrarna utgör ett allvarligt hot mot barnets hälsa och utveckling, så som fallet är där till exempel missbruk, fysisk och psykisk misshandel förekommer. Enligt vittnen och närstående till familjen finns inga sådana missförhållanden i detta fall. Tvärtom var barnet Domenic ett lyckligt, älskat och friskt barn när han levde med sin mamma och pappa.

Om det som står i domstolsprotokollen ska ligga till grund för en sådan drastisk åtgärd som denna, att hålla barn och föräldrar splittrade och åtskilda på detta sätt, riskerar vart och vartannat barn i detta land att bli familjehemsplacerat.

Vi vet att sociala myndigheter fattar felaktiga beslut, vi hör och läser om detta ibland. Jag anser och är fullt övertygad om att detta fall just är baserat på ett sådant felaktigt beslut.

Sverige är känt utomlands för att vara ett barnvänligt land, där man värnar om barnets bästa. Fallet med familjen Johansson har fått tusentals människor i olika länder att reagera och engagera sig och förskräckt undra vad som pågår i Sverige.

Jag vädjar nu till Er som kammarrättsråd i detta mål att göra allt som är möjligt för att återförena denna splittrade familj snarast och låta Domenic få leva sin resterande barndom tillsammans med sin mamma och pappa.

ADF/HSLDA File Second Application to Strasbourg on Behalf of Johansson Family



The Alliance Defense Fund, the Home School Legal Defense Association and local Swedish counsel have filed a second application on behalf of Annie and Christer Johansson to the European Court of Human Rights in Strasbourg. Nearly two years ago, as the Johansson’s and their seven year old son Domenic were on a plane ready to move to India to engage in missionary work with orphanages, Swedish police boarded their plane and took young Domenic into foster care simply for being home educated. Since that time, the family has not been allowed to use the lawyer or legal defense of their own choosing within Sweden despite no objective reason for Swedish court’s to reject this most basic of requests.

Christer, whom was arrested and imprisoned for several weeks among serious criminals without ever seeing a judge simply for taking Domenic home for one day without permission (he called the police the following day to let them know he was at his parents’ home with his son), was also forced to use a state appointed lawyer in his criminal proceedings despite having the financial resources to appoint his own lawyer. The claim filed by ADF and HSLDA makes clear that in a democratic society, it is unacceptable for Sweden to force legal counsel onto a family without any objective cause to do so and to reject a defendant’s right to use the lawyer of their own choosing. Johasson Released from Custody Today

Court Ordered Forensic Psychological Evaluation finds Johansson Psychologically Healthy

We've received word that Christer Johansson was released from police custody today immediately following a court hearing which was held as a continuance of the previous hearing of December 20, 2010. The original December 20th hearing was held as a result of an impulsive act on behalf of Johansson when on November 22, 2010, he took his son Domenic home, without permission, from a state supervised visit. According to Chapter 4 section 2 of the Criminal Code, this is punishable with prison for a minimum of one and maximum of ten years. Removing a child under fifteen years of age from the social services can constitute a crime against freedom or the promotion of escape and is punishable with fines or a prison sentence of up to one year.

During the December 20th hearing, the presiding judge, Lagman Mikael Mellqvist, withheld sentencing until Johansson had undergone a lengthy forensic psychological analysis. That analiysis, completed and submitted to the courts just this week, found Mr. Johansson to be psychologically sound.


This psychological finding is in direct opposition to the accusations made against Johansson by Gotland Social Services during both the December 2009 and September 2010 hearings to determine if Domenic should be returned to his parents or remain a ward of the Swedish state. In both court hearings, the Johanssons provided psychological reports stating Mr. Johansson was without a psychological diagnosis. However, Gotland Social Services continues to insist that Mr. Johansson suffers from a narcissistic disorder, while independent psychological assessments find him psychologically healthy. And now, in today's criminal proceedings the lengthy forensic psychological assessment, has found Mr. Johansson free of any psychological disorder.

In June 2010, HSLDA and the Alliance Defense Fund (ADF) filed a joint application at the European Court of Human Rights (ECHR) on behalf of the Johansson family. Since the Johanssons’ case has been heard at every level of the Swedish court system, the ECHR is the family’s only remaining recourse.

Although more than six months have now passed, the ECHR has failed to address the application, even though a special emergency measures order was requested. It is highly unusual that the Johanssons’ application still has not been assigned a case number. The court has also not responded to a letter requesting an explanation for the unusual delay. Instead, the application languishes while the Johanssons continue to endure the forced separation from their 9-year-old son Domenic.

Jag är mycket oroad över hur svenska myndigheter och domstolar har behandlat Christer Johansson och över LVU- omhändertagandet av hans son Domenic Johansson. När Christer måndagen den 22 november 2010 tog med sig Domenic gjorde han en överilad handling.

Christer Johansson is not a criminal, but he has had to endure huge psychological stress and pressure for the past one and a half years, ever since the Social Services took away his son on the weakest of pretexts.

I entreat you to please respect Christer Johansson’s human rights in accordance with the European Convention on Human Rights. Please ensure that justice is served and that Christer Johansson is released without further punishment.

Background

In June 2009 Swedish police boarded a plane where the Johanssons were leaving the country for Mrs. Johansson’s home country of India. The police had no warrant and did not charge the Johanssons with a crime.

The family continues to be kept apart through the deplorable actions of Swedish government officials. Nine-year-old Domenic remains in state foster care, now separated from his parents Christer and Annie for over 18 months. Christer, who took Domenic home for a short but “unapproved” overnight visit in early December, is still imprisoned.
